Terms of Service
These terms apply to all WebsitePlus subscribers. WebsitePlus is a trading name of Invicta Limited (NZBN: 9429050980383), based in Auckland, New Zealand. By using our service — whether verbally, in writing, or by making payment — you agree to these terms. If you have questions before signing up, get in touch.
01What's Included
Your monthly subscription covers the following:

| Ongoing basic updates | Minor text and image changes within fair use limits (see Fair Use Policy). |
What is not included
The following are outside the scope of the standard subscription. We'll always discuss and provide a written quote before any out-of-scope work is carried out:
- Additional pages beyond the initial 4-page build
- E-commerce or online store functionality
- New sections, major redesigns, or structural changes
- Custom integrations or third-party software connections
- Premium or specialist domain names (see Domain Names)
- Paid advertising setup or management (Google Ads, Meta Ads, etc.)
- Copywriting or professional photography
02Pricing & Payment
Monthly fee
The standard subscription is NZ$20 per month (or your applicable local currency rate as displayed at checkout), billed monthly in advance. There is no setup fee.
Out-of-scope work
Any work outside the scope listed in Section 1 will be discussed and quoted in writing before work begins. We will never charge for out-of-scope work without your prior written approval.
Failed payments
If payment fails we'll notify you by email. If payment isn't received within 14 days, we reserve the right to suspend the site until resolved. Non-payment beyond 30 days may result in cancellation and the site being taken offline.
03Fair Use Policy
Your subscription includes ongoing basic content updates. This is intended for routine maintenance, not ongoing development work.
Included under fair use
- Updating existing text — business hours, service descriptions, contact details, pricing
- Swapping or adding photos and images within existing sections
- Minor layout tweaks within existing pages
- Updating contact form fields or recipients
Not included under fair use
- Building new pages or sections
- Redesigning or restructuring existing pages
- Integrating new functionality (booking systems, maps, etc.)
- Work that would reasonably take more than 1–2 hours in any calendar month
Out-of-fair-use requests won't be refused — they'll simply be acknowledged and quoted separately before any work begins.
04Domain Names
What counts as a standard domain
One standard domain is included in your subscription. Standard domains are those that can be registered and renewed for NZ$35/year or less, typically:
- .co.nz, .nz, .net.nz, .org.nz
- .com, .net, .org
- Other common TLDs at equivalent cost
Premium or specialist domains
Premium, short, or specialist domains — such as .io, .ai, .shop, .co, single-keyword .com domains, or any domain priced above NZ$35/year — are not included. If you want one, we'll advise you of the additional annual cost before purchasing.
Domain ownership
The domain is registered on your behalf. Beneficial ownership vests after 12 months of active subscription. If you cancel before 12 months, the domain remains with WebsitePlus. After 12 months, domain arrangements on cancellation are discussed with you directly.
05Cancellation
Cancelling your subscription
You can cancel at any time by emailing us. There is no cancellation fee.
Domain ownership vests after 12 months of active subscription. If you cancel before 12 months, the domain remains with WebsitePlus. We may offer to transfer or sell it back to you at cost at our discretion. After 12 months, domain arrangements on cancellation are discussed with you directly.
On cancellation: your site goes offline at the end of the current billing period, and your content is available for download for 30 days.
Cancellation by us
We may cancel the subscription (with 30 days' written notice) if we're no longer able to provide the service, if you breach these terms, or if payment remains unresolved beyond 30 days. If we cancel for reasons other than your breach or non-payment, we'll issue a pro-rata refund for any unused billing period.
06Your Responsibilities
To build your website we'll need you to provide the following in a timely manner:
- Your business name, trading name, and contact details
- A description of your services and/or products
- Your logo (vector or high-resolution PNG preferred)
- Photos or images you want to use, or confirmation that stock imagery is acceptable
- Brand colours (hex codes or reference images)
- Any other text content, special requirements, or design preferences
Delays in providing content may delay your launch. We are not liable for launch delays caused by late or incomplete content.
You also confirm that all content and materials you provide are yours to use, and that the information you share about your business is accurate to the best of your knowledge.
07Intellectual Property
Your content
All content, images, logos, and materials you provide remain your intellectual property. You grant us a licence to use them solely to build and operate your website.
Website design
While your subscription is active, you have a non-exclusive licence to use the published website. The underlying design and code are created by WebsitePlus and remain our intellectual property.
On cancellation
We'll provide an export of your website content (text and images) on request. Source code and design assets are retained by WebsitePlus.
08Limitation of Liability
To the maximum extent permitted by New Zealand law:
- We are not liable for any indirect, incidental, or consequential loss arising from your use of (or inability to use) the website.
- Our total liability in any calendar month shall not exceed the subscription fee paid in that month.
- We do not guarantee specific search engine rankings, traffic volumes, or business outcomes.
Nothing in these terms excludes or limits liability that cannot lawfully be excluded under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986.
09Privacy
We collect and hold your personal information for the purpose of providing the service. We will not sell or share your information with third parties except as required to deliver the service (e.g. domain registrars, hosting providers). Our handling of your information is governed by the New Zealand Privacy Act 2020.
10Governing Law & Disputes
These terms are governed by the laws of New Zealand. Any dispute will first be addressed through good-faith negotiation. If unresolved, disputes may be referred to mediation or the Disputes Tribunal (for claims within its jurisdiction) before any other legal proceedings are commenced.
11Changes to These Terms
We may update these terms from time to time. We'll notify you by email at least 14 days before any material changes take effect. Continued use of the service after that date is acceptance of the updated terms. If you don't accept the changes, you may cancel before they take effect.
